General Terms and Conditions

Article 2 – Definitions

In these terms and conditions, the following definitions apply:

  • Entrepreneur: acting under the name Lodyfair, offering products to consumers at a distance.
  • Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
  • Distance contract: an agreement concluded between the entrepreneur and the consumer via the webshop, exclusively using one or more techniques for remote communication.
  • Right of withdrawal: the consumer's option to withdraw from the distance contract within the cooling-off period.
  • Cooling-off period: the period within which the consumer can exercise their right of withdrawal.
  • Day: calendar day.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer from the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
  2. Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. The consumer can save these terms and conditions so that they can be consulted later.
  3. Situations not covered by these terms and conditions should be assessed in the spirit of these terms and conditions.

Article 4 – The Offer

  1. Every offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to allow a good assessment by the consumer. Images are a true representation of the products; minor deviations in color or size may occur.
  2. Obvious mistakes or errors in the offer are not binding on the entrepreneur.
  3. Every offer contains such information that it is clear to the consumer what the rights and obligations are that are attached to the acceptance of the offer.

Article 5 – The Agreement

  1. The agreement is concluded at the moment the consumer accepts the offer and fulfills the conditions set therein.
  2. The entrepreneur confirms receipt of the acceptance of the offer electronically. As long as this confirmation has not been sent, the consumer can dissolve the agreement.
  3. The entrepreneur takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment and secure payment methods.

Article 6 – Right of Withdrawal

  1. The consumer can dissolve an agreement regarding the purchase of a product during a cooling-off period of 14 days without giving reasons.
  2. The cooling-off period starts on the day after the consumer, or a third party designated by the consumer who is not the carrier, has received the product.
  3. When the consumer has ordered multiple products in the same order that are delivered separately, the cooling-off period starts on the day the consumer received the last product.
  4. During the cooling-off period, the consumer will handle the product and its packaging with care. The consumer may only unpack or use the product to the extent necessary to ascertain the nature and characteristics of the product, as would be allowed in a physical store (for example, trying on a piece of clothing).
  5. The consumer is liable for any depreciation of the product resulting from use that goes beyond what is permitted in paragraph 4.

Article 7 – Exercise of the Right of Withdrawal and the Costs Thereof

  1. The consumer notifies the withdrawal within the cooling-off period via email to info@lodyfair.nl or via the model withdrawal form (included as an annex to these terms and conditions).
  2. As soon as possible, but no later than 14 days after notification, the consumer returns the product.
  3. The consumer returns the product with all supplied accessories, if reasonably possible in its original condition and packaging.
  4. The direct costs of returning the product are borne by the consumer.
  5. The entrepreneur will refund all payments from the consumer, including any standard delivery costs charged by the entrepreneur, without delay and no later than 14 days after the consumer has notified the withdrawal. The entrepreneur may wait with repayment until the product has been received or until the consumer demonstrates that the product has been returned, whichever comes first.
  6. For repayment, the entrepreneur uses the same payment method that the consumer used, unless the consumer agrees to a different method. The repayment is free of charge for the consumer.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  1. Products manufactured according to the consumer's specifications or clearly custom-made (custom work).
  2. Products that are sealed for reasons of health protection or hygiene and whose seal has been broken after delivery.
  3. Products that, by their nature, have been irrevocably mixed with other products after delivery.

Article 9 – The Price

  1. The prices stated in the product offer include any taxes, unless otherwise stated.
  2. Shipping costs, if applicable, are stated separately before the consumer completes the order.
  3. During the validity period stated in the offer, prices will not be increased, except for price changes resulting from changes in VAT rates.

Article 10 – Conformity and Warranty

  1. The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer, and the reasonable requirements of soundness and usability.
  2. The consumer has the legal rights and claims (legal conformity). A guarantee provided by the entrepreneur, manufacturer, or importer does not detract from these legal rights.
  3. Any defects or incorrectly delivered products must be reported to the entrepreneur in writing via info@lodyfair.nl within a reasonable time after discovery.

Article 11 – Delivery and Execution

  1. The entrepreneur will exercise the greatest possible care when receiving and executing orders.
  2. The place of delivery is the address that the consumer has made known to the entrepreneur.
  3. The entrepreneur will execute accepted orders with due speed, but no later than within 30 days, unless a different delivery period has been agreed upon. In case of delay, the consumer will be informed thereof and has the right to dissolve the agreement free of charge.
  4. The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer.

Article 12 – Payment

  1. Payment takes place via the payment methods offered on the website, at the time of placing the order.
  2. The consumer has the duty to immediately report any inaccuracies in payment details provided or stated to the entrepreneur.

Article 13 – Complaints Procedure

  1. Complaints about the execution of the agreement will be submitted to the entrepreneur via info@lodyfair.nl within a reasonable time, fully and clearly described.
  2. Submitted complaints will be answered within a period of 14 days from the date of receipt. If a complaint requires a longer processing time, the consumer will receive a confirmation of receipt within 14 days and an indication of when a more detailed answer can be expected.
  3. The consumer can also submit a complaint via the European ODR platform: https://ec.europa.eu/consumers/odr.

Article 14 – Disputes and Applicable Law

  1. Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
  2. Disputes will be submitted to the competent court, unless the law mandatorily dictates otherwise.
